§ 1. Scope

These General Terms and Conditions govern the legal relationship between Martin Lippert, Am Jubiläumsstein 24, 63322 Rödermark (hereinafter "Provider"), and all persons who use the Provider's services (hereinafter "Participant" or "Customer"). These T&C apply to all contracts in connection with workshops, courses, training sessions and other coaching services relating to the Wim Hof Method.

The application of any deviating or supplementary terms and conditions of the Customer is excluded unless they are expressly acknowledged in writing.

§ 2. Contract Formation / Booking

The offer of a service constitutes an invitation to submit an offer. Registration for participation in a workshop or course is a binding offer by the Customer to conclude a contract. The contract is concluded as soon as the Provider confirms the registration in writing (by email or post). Registration can be made online via the website, by email to mail@martin-lippert.de or by telephone.

By registering, the Participant accepts these T&C and agrees to the data protection provisions (see Privacy Policy).

A right of withdrawal upon conclusion of the contract exists pursuant to the statutory provisions. For small businesses (§ 19 UStG), the statutory right of withdrawal is only available to a limited extent.

§ 3. Services

The Provider offers workshops, individual and group training sessions as well as online courses on the Wim Hof Method. The precise description of the service, including content, duration, group size and location, is set out in the respective course description.

Participation is possible from the age of 18. Deviations from this age limit are indicated in the course description. The Provider reserves the right to reschedule or cancel courses if the minimum number of participants is not reached. In this case, the Customer will be notified without delay and may choose between participation at an alternative date or a full refund.

The precise course content, methods and training techniques are determined by the Provider. Services are provided to professional standards.

§ 4. Prices and Payment

Prices are stated in the course description and include all services, teaching materials and, for in-person courses, venue infrastructure. The Provider is a small business pursuant to § 19 UStG (German VAT Act) and therefore does not charge VAT. The stated prices are final prices inclusive of all charges.

Payment is due upon conclusion of the contract (immediately after booking confirmation). Payment is by bank transfer. Valid bank details will be communicated. For payments by bank transfer, payment must be received within 5 working days of the booking confirmation.

If payment is not received on time, the course registration will be deemed cancelled and cancellation fees may apply (see § 5). The Provider reserves the right to refuse participation in the course until payment has been received.

Invoices will be issued on request. Information on the operator and tax number can be found in the Imprint.

§ 5. Cancellation and Withdrawal

General cancellation conditions: The Participant may withdraw from their booking. The amount of cancellation fees depends on how far in advance of the course start date the cancellation is made.

  • Cancellation more than 14 days before the course starts: Full refund with no fees. The cancellation request must be made in writing (email or post).
  • Cancellation 14 to 8 days before the course starts: 50% refund of the course fee. The remaining 50% is retained as an administration fee.
  • Cancellation 7 days or fewer before the course starts: No refund. The full course fee is charged.
  • Substitute participant: However, within the last 7 days before the course starts, the Participant may nominate a person of their choice as a substitute participant. The fully paid fee will then be transferred to that substitute participant.

Cancellations must be communicated to the Provider in writing (by email to mail@martin-lippert.de). The time of receipt of the email is decisive. Verbal cancellations are not valid.

In cases of illness or important personal reasons, the Provider reserves the right to decide differently on a case-by-case basis and to reach an amicable arrangement.

§ 6. Health Requirements

The Wim Hof Method is an intensive breathing and endurance training that affects heart rate, blood pressure and oxygen saturation. Participation requires a state of health and fundamental physical fitness. All participants are solely responsible for being able to meet the physical and psychological demands.

Health declaration: All participants must sign a health declaration before the course begins, confirming that no contraindications exist and that they have consulted a physician if any uncertainties exist.

Contraindications: Participation is excluded or only possible with medical clearance for persons with:

  • Heart conditions (e.g. high blood pressure, cardiac arrhythmias, heart valve disease, heart failure)
  • Epilepsy or other neurological seizure disorders
  • Pregnancy
  • Severe respiratory diseases or asthma

Other illnesses or the use of medications that may interact with intensive breathing training should be discussed with the Provider in advance.

The Provider reserves the right to exclude a participant from participation if there are justified doubts about their suitability or if safety-relevant contraindications exist. In this case, a partial refund may be granted.

§ 7. Liability Disclaimer

The Provider trains and teaches to the best of their knowledge and belief. The Wim Hof Method is a training concept associated with physical exertion and potential health risks. The Participant consciously accepts these risks.

The Provider is not liable for:

  • Physical or psychological harm or injuries occurring during or immediately after training
  • Health consequences resulting from pre-existing conditions or unrecognised contraindications
  • Insufficient training effects or lack of results
  • Lost or damaged personal belongings during training
  • Indirect or consequential damages of any kind

This limitation of liability does not apply in cases of gross negligence or wilful misconduct on the part of the Provider.

It is strongly recommended to consult a physician before participating in the Wim Hof Method, especially in the case of pre-existing conditions or an unclear state of health.

§ 8. Data Protection

The processing of personal data is carried out exclusively in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). All personal data is treated confidentially and is not disclosed to third parties unless this is necessary for the performance of the contract.

The Privacy Policy of this website applies to the storage and processing of data in connection with the booking (name, email address, telephone number, address, payment information). The Participant agrees to the processing of their data to the extent necessary for the fulfilment of the contract.

§ 9. Place of Jurisdiction and Applicable Law

These T&C are subject to the law of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from or in connection with these T&C is Rödermark or the court with competent jurisdiction pursuant to the rules of the Code of Civil Procedure.

Insofar as the Participant is a consumer within the meaning of § 13 BGB (German Civil Code), the provisions of German consumer protection law apply accordingly. The EU Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr/. The Provider is not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

Should any provision of these T&C be invalid, the remaining provisions shall remain valid. The invalid provision shall be replaced by a valid provision that corresponds to the economic purpose and intent.
